Members Present: Chairman Ken Selzler, Supervisors Paul Zent and Kerry Olson; Zoning Board Jerry Kunz and Rick Solberg;  Building Inspector, Shawn Whitney was present had to leave early; Road Supervisor, Chad Schneider; Weed Board, Terry Mauch; Treasurer, Kaylene Schoenhard and Clerk, Cyndy Meidinger.

Members Absent: Assessor, Mark Splonskowski

Chairman Selzler opened the meeting, the October minutes were discussed. Supervisor Olson had several changes in the minutes to the attention of the board. After discussion Supervisor Zent made a motion to approve the minutes as corrected, Supervisor Olson seconded the motion.  The motion was unanimously approved.

School Board Report: There will be a meeting for basketball for the parents. Supervisor Zent asked where practice and the games would be held. The sight remains to be determined at this time. The school board is pleased with the parking lot improvement.

Treasurer’s Report: Treasurer Schoenhard reported there was a total debit of $28,357.87 total credit of $1066.80 with an ending balance of $122.056.45

Clerk Meidinger said there was some confusion on payment for the parking lot improvement. She said there was an overpayment to Great American Trucking and underpaid Northern Improvement for ACS parking lot improvement. She contacted Great American Trucking and they will credit the over payment to an outstanding invoice for stump removal.  After discussion on the bills submitted for payment Supervisor Zent made a motion to pay all bills submitted with a second from Supervisor Olson, the motion was unanimously approved.

Clerk Meidinger reported on her meeting with Point CPA.  It was the recommendation of Point CPA to go  to 2013 and get the info for employees and there was a possibility this would be an easy fix. It was also their recommendation the township purchase an accounting software; their recommendation was to use Quick Books.   Supervisor Zent asked Treasurer Schoenhard if she was familiar with the program. Treasurer Schoenhard responded she was not but did not think it would be too difficult. Supervisor Zent said the township would pay for any training needed. There was also discussion on a possible credit card or debit card for the treasurer to buy necessary items without tracking down the supervisors to get signatures. Treasurer Schoenhard said she would check it out but it might not be possible since there needs to be 2 signatures on the checks.  Supervisor Olson made a motion for purchase of Quick Books soon to get it up and running.  After discussion, Supervisor Zent seconded the motion. The motion was unanimously approved. Chairman Selzler asked Clerk Meidinger to contact Tom Moe the NDTOA lawyer for any insight into tax preperation.

Weed Board Report: Weed Board member Mauch reported not much was going on now; but did have complaints about the lack of weed spraying in the ditches this season.

Zoning Board Report:  Zoning Board Members Kunz and Solberg had nothing-new nothing to report.

Chairman Selzler had a request for a variance to change the set back from 15’ to 3’ in Prairie View Subdivision, 5520 Meadowlark Lane to allow for the construction of an accessory building.  It is in Burleigh County’s jurisdiction but they want input from ACT.  After discussion Supervisor Zent made a motion to deny the motion; Supervisor Olson seconded the motion. The motion was unanimously approved.

 Chairman Selzler also had a request for a special use permit for the same parcel (Prairie View Subdivision, 5520 Meadowlark Lane). This special use permit is for an accessory building size increase to 2,088 sq. ft. (288 sq. ft.) over the allowable sq. ft. After discussion Supervisor Olson made a motion to approve the special use permit if all setbacks are met, the motion was seconded by Supervisor Zent the motion was unanimously approved.

Assessor Report:   Assessor Splonskowski was not present at the meeting.  Supervisor Zent said Assessor Splonskowski contacted him and reported he had the computer programed and will start on Friday doing the building permits and getting everything input into the computer.

Road Supervisor’s Report: Supervisor Schneider had 1 driveway permit for Rocky Hewson in Leisure World Estates  address  2001 Maple Lane  paid check # 1020 for $25.00 permit # 10-15-2001.

Supervisor Schneider had a call about traffic signs in Copper Ridge Subdivision he told the caller Copper Ridge is in the City of Bismarck’s jurisdiction and they would need to contact the City of Bismarck to get signs.

62nd St SE was bladed after the rain and it turned out very nice. Some grass, weeds and dirt were pulled up on the roadbed and could cause a traffic hazard.  Supervisor Schneider said he would move the weeds and grass off the road with his loader tractor.

There was discussion about a culvert on 119th St SE there is a good possibility it is a concrete culvert. The county will clean it out and see what repairs can be made.

Zoning Board Member Kunz asked if some repairs could be made on Northgate Drive, there are some potholes by the corners. Supervisor Schneider will talk to the county and see what can be done.

 Road Supervisor Schneider would like the ACT board to contact the county about the windrowing of gravel on the roads.  He feels the board would have more weight with the county. Supervisor Schneider also said in 2016, the highway department would be a little stricter about scheduling maintenance, county roads first, township roads second and rural residential roads third.

Clerk Meidinger passed out the 2016 Road Maintenance Agreement for review. The board chose to discuss the agreement @ the December meeting after the board members had more time to review the agreement.

Building Inspectors’ Report:  Inspector Whitney was not able to stay @ the meeting but he gave a report to Supervisor Zent.  There were 2 permits 1 for Dan and DeAnne Burgard 1915 Maple Lane residential permit # 2015-16 for a 28’ x 30’ extension to shop (840 sq. ft.)  no concrete floor paid $200.00 check #1328 valuation $17,640. 

Charles Pifer 8401 Cresthill Road residential permit #2015-24 for a 14’ x 28’ (392 sq. ft.) garage addition to existing shop, slab on grade paid $60.00  check # 7928 valuation $8232.00.

Inspections: Tim Kuennen Foundation inspection x 2; Pifer foundation inspection; Rocky framing inspection; Herman framing inspection; Hoffman footing inspection; Fredrick’s  upstairs framing inspection and  final inspection for Richards.

Inspector Whitney’s meeting with Ray Ziegler from the County Building Inspections resulted in all setbacks on 93rd St SE is 175’.

There is a training session in Chaska MN.  Feb 8-12 2016 the session will be 3 days (Wed-Fri) cost of training $1830.00 $110.00 per night motel, + expenses (food, mileage & time spent).

Other Business:   Mr. Krein, whose mother lives next door to Mike Markwed’s on 93rd St SE was at the meeting and asked about Markwed’s permit and what classification was the permit. Chairman Selzler said the permit was Ag since the area had ever been re classified to residential.  Mr. Krein also inquired if the permit will be posted on the website. The permits are not posted on the web site; but can be viewed if necessary at the school. Mr. Krein’s concerns were that it was not a commercial permit and questioned the amount of cattle to be a feedlot.  Mr. Mauch stated 1,000 head of cattle or more are considered a feedlot.

Chairman Selzler asked if there was other business to discuss; being none, he adjourned the meeting.
