ACT Board of Supervisors Meeting

Members Present: Supervisors, Mark Springer & Paul Zent; Assessor, Mark Splonksowski; Building Inspector, Greg Hillig; Clerk, Cyndy Meidinger; Treasurer, Jamie Vetsch; Weed Board, Terry Mauch and Zoning Board, Rick Solberg.

Members Absent: Supervisor, Dave Nehring; Road Supervisor, Chad Schneider and Zoning Board Jerry Kunz.

In the absence of Chairman Nehring Supervisor Springer opened the meeting. Supervisor Springer asked for any corrections or additions to the June minutes. There was one correction noted the Ostendorf address was incorrect the correct address is 7340 62nd Ave SE. With no other corrections or additions Supervisor Zent made a motion to accept the minutes as corrected. The motion received a 2nd from Supervisor Springer. The motion was unanimously approved.

Consent Agenda: Nothing to discuss.

Public Hearing: Ostendorf Subdivision Request; Supervisor Springer suspended the regular meeting and opened the Zoning Board. Mr. Ostendorf was at the meeting and stated he wanted to subdivide his property @ 7340 62nd Ave SE into 2- 20 acre lots. He has the property for sale now as a 40-acre parcel. If the property should sell before the next Burleigh County Commission meeting it will be sold as a 40-acre parcel. If the property does not sell before the meeting it will be split into 2-20-acre parcels. A discussion followed. There was no opposition to the request from the board or residents in attendance. Supervisor Springer said the final vote would come at the end of the meeting to allow time for other questions.

School Board Report: Supervisor Springer reported the school board election resulted in 3 new members to the school board, Greg Knutson, Katie Atkinson and Joe Gartner. He also said at the 3 to 5-year planning meeting the people in attendance agreed Apple Creek School needed a gym. The school will go forward to find ways to fund the project and keep the ACT residents in the loop. Supervisor Zent suggested Apple Creek School Board include an ACT board member in their committee. The school board had a special meeting to discuss the repair or replacement of the school roof and discussed the septic system and the best way to go forward with the septic system. The new security system is now in place.

Assessor’s Report: Assessor Splonskowski stated the county had the equalization meeting in June and that went well. There was only 1 person there and that person was not from ACT. He has been in contact with one person requesting an abatement which should be ready for the board’s consideration at the August meeting. He also stated he will be working on the subdivisions where he left off when he started the equalization process.

Treasurer’s Report: Treasurer Vetsch said there is $175,075.20 in checking and $186,775.51 in savings. She had 2 invoices submitted for payment Burleigh County Highway Dept for $ 2,714.40 for crack sealing; Bismarck Tribune $17.43 for Ostendorf Public Hearing ad and 2nd Qtr. Payroll for a total of $7.762.10. A discussion followed and Supervisor Zent made a motion to approve the treasure’s report and approve payment for all invoices submitted and to pay 2nd Qtr. Payroll. The motion received a 2nd from Supervisor Springer. The motion was unanimously approved.

Clerk Meidinger stated she talked to Burleigh County Auditor Glatt and the township needs to set a date for the budget hearing before August 10th so estimated statements can be sent out. The township must have the hearing between September 7th and October 7th After discussion the board agreed to set the date for the budget hearing to be held on September 10th the meeting will be held in conjunction with the regular meeting.

Building Inspector’s Report: Building Inspector Hillig said he wrote 3 permits

  • Chance Price @ 11533 Herman Drive for a 2,036 sq. ft home 6-bedroom 4 bath /w attached garage permit # 2018-7 permit fee $1,822.27 paid check #1216 valuation of work $412,244.00

  • Tanya Noonan 3000 93rd St SE new deck 14’x14’ permit # 2018-8 permit fee $76.15 paid check # 1013 valuation of work $2,940.00

  • Ron Morlach 9234 Lincoln Road enlarge door on storage building and add vaulted trusses

    Permit fee $118.50 paid check #2264 valuation of work $4,700.00.

    Total of new valuation is $419,884.00

Weed Board: Board Member Mauch said there was some spraying of leafy spurge on the spots he had flagged. BN also contacted him, and they will be spraying for spurge on the right of way of the railroad tracks.

Other Business: Supervisor Zent said BN gave Arnold Schieve the right of way he has been asking for.

Sherry Norbeck was at the meeting wanting suggestion from the board on her property off 80th St SE that had burned. Since the property had more than 50% damage she must tear it down and could build but there are a lot of steps that need to be completed. She was asking the board for any suggestions. She has found a house she could move but can’t find a 5-acre parcel. She is hoping to find a piece of property in ACT.

Public Hearing Continuation: Supervisor Springer asked if there was any further discussion on the Ostendorf lot split. Being none, he asked for the board’s wishes on the matter. Supervisor Zent made a motion to approve the concept to split Mr. Ostendorf’s lot @ 7340 62nd Ave SE. into 2 20-acre lots. The motion was 2nd by Supervisor Springer. Roll Call Vote, Supervisor Zent, yes; Zoning Board Member, Solberg yes and Supervisor Springer, yes; Motion Carried. Supervisor Zent said the township will need a copy of the lot survey for the township records if in fact the property does get split.

Zoning Board Report: Terry & Debra Hoerer 9005 Lincoln Rd update. Terry Mauch reported there has been some clean up done on the property. He does not know where the stuff went but the front has started to get cleaned up.

With no other business to discuss Supervisor Springer adjourned the meeting.
