Since the COVID 19 Virus this meeting of ACT was held via Zoom

Members joining the meeting:  Supervisors, Mark Springer, Nathan Kuntz & Dusty Hasper; Building Inspector, Greg Hillig; Clerk, Cyndy Meidinger; Road Supervisor/Zoning Board, Roy Kuil; Treasurer, Jamie Vetsch; Weed Board, Terry Mauch and Zoning Board, Jerry Kunz.

Members Absent: Assessor, Mark Splonskowski.

First order of Business oath of office for Supervisors, Clerk and Zoning Board.

With the oath of office taken next order of business was to elect the chairman for the year. Supervisor Kuntz nominated Mark Springer for chairman, the motion received a 2nd from Supervisor, Hasper. The motion was unanimously accepted.

Chairman Springer asked if the board had any corrections or additions to the March Minutes. Being none, Chairman Springer made a motion to accept the minutes as written. Supervisor Hasper 2nd the motion and the motion was unanimously approved.

 Consent Agenda: There were two items for discussion. Both were liquor license approval requests. One was from Apple Creek Country Club by Ty Hauglie for a Type E license which is a full privilege license for both on & off sale of beer & all alcoholic beverages. The other request was from Glen Emineth @ South Forty Wedding Events, LLC for a type C license which is for on sale only, both beer & all alcoholic beverages. ACT does not issue the licenses.  Burleigh County issues the licenses; but ACT has the option to allow the license to be granted. After discussion Supervisor Kuntz made a motion to grant both license requests. Chairman Springer 2nd the motion and the motion was unanimously approved.

School Board Report: Chairman Springer said the school board has 5 people on the search committee for the proposed multi use building for Apple Creek School. Chairman Springer said the school board would like to see more participation from the residents but will go forward and see what happens.

The other school board item is the board had teacher contract meetings and Sonya Miller the 5th grade teacher/principal will resign the end of this term in May.

 

Treasurer’s Report:  Treasurer Vetsch reported there is $91,019.22 in checking and $250,010.12 in savings. She also recommended the township investigate computers and accounting software for treasure and clerk. When a person leaves the board all township info will go with the computer.  Chairman Springer said he feels that should be a serious consideration. He feels there should be no mixing of personal and township information. There have been audits in the past where townships have failed, and he would not like to see ACT fail an audit. Treasurer Vetsch said she will get payroll done in the next few days. She must verify some of the figures with board members and then will get the signatures so payroll can be sent out.  After discussion Supervisor Kuntz made a motion to pay all bills presented 2nd by Supervisor Hasper. The motion was unanimously approved

Assessor’s Report: Assessor Splonskowski was not able to join the meeting and gave his report to Supervisor Kuntz. He reported there were no residents- complaints @ the tax equalization meeting. Board Members Kuntz & Hasper & Clerk Meidinger & Assessor Splonskowski were the only ones attending the meeting. Assessor Splonskowski reported everything is going well on the assessing side. If there are any questions, there will be the county equalization meeting in June.

 

Road Supervisor’s Report: Supervisor Kuil had reported on the roads that are needing attention.

  • Northgate Dr east of 66th St SE needs additional attention. While some crushed concrete was added recently it needs graded again. This road is incredibly soft, and cars sink into the roadway.
  • Bar D Rd needs resurfacing it is hard packed clay and has little gravel. This surface become very slick when wet.
  • Omar St needs additional resurfacing.
  • 119th St SE from Apple Creek Rd to 22nd Ave SE needs resurfacing it is hard packed clay.
  • Sunrise Ave needs resurfacing it is hard packed clay, the street at the second house on the left will have water passing over it during heavy rain and the culverts may be clogged. If I need to be referred to someone else for the culverts, please let me know.
  • Irish Ln east of Susan Dr need to be resurfaced.
  • 93rd St SE Again has several potholes between Apple Creek Rd and Lincoln Rd. Many of these are the holes are same ones repaired earlier this year.

Jerry Kunz said the county had done some work on Northgate and it was better but still needs improvement.

Supervisor Kuil issued 2 approach permits for March & April.

Clerk Meidinger asked if the gravel request had been turned into the county for the year. Supervisor Kuil said no he must have missed the request. Clerk Meidinger said she would send a gravel request to him after the meeting and would contact the county about it being late and see if the county would make an allowance the request was supposed to be turned in by the 15th of April.

Building Inspectors Report:  Inspector Hillig issued 2 building permits for April.

  1. Permit #2020-2 for Tim & Karen Hagen @ 9220 Creekside Drive Bismarck, new pole building for a shop. Size 80’x40’x16’ total sq. ft. 1,600. Valuation $67,200.00 permit fee $485.69 pd check # 3587
  2. Permit #2020-3 Deanne Azure @ 6300 Omar St new home with attached garage and walk out basement. Size 73’x69’x9’ total sq. ft is 5,234. Valuation $450,390.00 permit fee $1,974.78 pd check #6417

Supervisor Kuntz suggested Building Inspector Hillig be certified by the state to help protect ACT from possible lawsuits. Clerk Meidinger suggested ACT pay for any cost training might incur. Chairman Springer said the board would reimburse for any costs. Chairman Springer had been in contact with Commissioner Bitner the county does not require building inspectors be certified.  Supervisor Kuntz said there were no complaints on anything Greg has done so far. This would just be proactive to help protect the township from possible liability in the future. Supervisor Kuntz said he would send Inspector Hillig the link from the state site and he could investigate and report back @ the May meeting.

Weed Board: Board Member Mauch said he did not have anything to report but the county has a new Weed control officer Dylan Ripplinger phone # 701-934-0088.

Zoning Board:  Chairman Springer suspended the regular meeting of ACT and opened the Zoning Board.

First item up for discussion was a request from Supervisor Kuntz to rezone and plat a 5 ¼ acre plat from his father-in-law Alvin Braun. There had been approval given @ a previous meeting contingent on getting a signed purchase agreement between himself his wife and in-laws and a plat of the property.  He was now ready to get the final approval.  Zoning Board Member Kuil made a motion to approve Supervisor Kuntz’s request and Zoning Member Jerry Kunz 2nd the motion.  Roll call vote followed Zoning Members Kuil and Jerry Kunz yes; Supervisor Hasper yes, Supervisor Nathan Kuntz, abstain and Chairman Springer, yes. Motion carried.

2nd item for discussion Corby & Alison Ward wanted to put a manufactured home on property they bought, the street address is 8650 Pleasantview Rd. in section 28 Legal Description 39-138-79-20-00-032. A manufactured home has wheels and a metal frame. It will be put on piers. There will have to be state inspections done by the county. Supervisor Hasper asked if the approach was a shared approach and Mr. Ward said it is. The Wards have been in contact with Burleigh County Building Inspections and have met all their requirement and are waiting on approval from ACT so they can start. A discussion followed and resulted in a Motion from Zoning Member Kuil to approve the request, Zoning Member Jerry Kunz 2nd the motion. The Motion was unanimously approved. Chairman Springer apologized for the delay and told the Wards they could contact Inspector Hillig and get the required permits.

With no other zoning issues to discuss Chairman Springer closed the Zoning Board and reconvened the regular meeting of ACT.

Other Business: The next meeting of ACT will be on the regular date Monday May 4th. If nothing changes it will be via Zoom unless the governor gives the go ahead to meet. With no other business to discuss Chairman Springer adjourned the meeting @ 7:47 PM
