ACT Board of Supervisors Meeting

In Attendance: Monte Sicble, Gaylen Dewing, Dan Reis, Jerry Kunz, Terry Woehl, Stephen Schnaible, Dusty Hasper and Randy Strom
1. Call to Order
Chairman Dewing called the meeting to order at 7:02pm.
Roll Call: Dan - Present, Gaylen - Present, Monte - Present, Jerry - Present, Terry - Present
2. Minutes Review
A. Corrections and approval of the Minutes from the previous meeting.
Supervisor Reis made a motion to approve the minutes from the August 5, 2024 meeting.
Supervisor Sicble 2nd the motion.
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes
3. Old Business
Supervisor Dewing recessed the regular board meeting and called to order the Zoning portion of the meeting.
Roll Call: Dan - Present, Gaylen - Present, Monte - Present, Jerry - Present, Terry - Present
a. Ordinance committee advertisement and discussion
Discussed creating a 3-member committee to review and recommend changes to ACT ordinances.
Items discussed in relation to the committee
- Will the positions be paid
- Should there be any deadlines for goals or completion
- Will the committee require special meetings to interface with the board and public
Supervisor Woehl made a motion "The Apple Creek Township (ACT) board is seeking three ACT citizens
to participate on a committee to review potential changes to the ACT ordinances. Any changes to the
ordinances will require the approval of the Apple Creek Township"
And asked for it to be posted to the township website and if anyone is interested, please contact Terry
or any board member.
Supervisor Kunz 2nd the motion
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes, Terry - Yes, Jerry - Yes
Motion approved.
4. New Business
Supervisor Reis made a motion to hire ES Attorney, John Ward to develop the road restriction ordinance
and associated work.
Supervisor Dewing 2nd the motion.
Vote: Dan - Yes, Gaylen - Yes, Monte - No
Motion Approved.
Chairman Dewing recessed the Zoning portion and resumed the regular meeting.
5. Area Reports
A. School Board Report - Terry Woehl
Estimate to fix the school's foundation is about $45,000. Still collecting bids. Would need to be done
next Spring after school is out.
B. Treasurers Report - Randy Strom
Checking: $253,254.45
Savings: $36402.91
CD's: 4 @ $50k and 1 @ $100k
Bills: Lawyers $300.00, Burleigh County $105,918.08, Clerk Reimbursement $24.80.
Supervisor Reis made a motion to pay the bills.
Supervisor Sicble 2nd the motion.
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes
Motion approved.
C. Assessors Report - Marie Horning
Supervisor Sicble made a motion to hire Marie Horning as ACT's assessor.
Supervisor Reis 2nd the motion.
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes
Motion approved.
D. Building Inspector's Report - Burleigh County
1. Review and approve the permit report
Nothing on the report related to ACT.
E. Road Supervisors Report - Roy Kuil
Woodrow Court in Copper Ridge has a culvert issue that needs to be cleaned.
Copper Lane had runoff that dug up the east side of the road. Roy emailed the county
to have them repair this.
Reports of Palamino Dr having a rutted road.
Terry Reported that the County mowed over two culvert ends, he will get the info to Roy.
F. Weed Supervisors Report - Dusty Hasper
Darrin Johnson is the County weed supervisor; he restarted the cost sharing which is 50/50.
The County is getting caught up on the ditches.
6. Zoning Board
Sam Helvig reported a couple violations on number of horses allowed by lot size in his development.
The reported violations are by:
Joseph and Tiffany Gartner - 11703 Elsa Rosa Dr
Scott and Amanda Reuschlein - 11581 Hillard Dr
The board is going to do some research and possibly talk to the reported violators.
