ACT Board of Supervisors Meeting

In Attendance: Monte Sicble, Gaylen Dewing, Dan Reis, Jerry Kunz, Terry Woehl, Stephen Schnaible, Dusty Hasper, Roy Kuil and Randy Strom
1. Call to Order
Chairman Dewing called the meeting to order at 7:01pm

2. Minutes Review
A. Corrections and approval of the Minutes from the previous meeting.
Supervisor Reis made a motion to approve the minutes from the Oct 7,
2024 meeting.
Supervisor Sicble 2nd the motion
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes
Motion approved
3. Old Business
a. Update on ordinance committee
Five citizens are interested in volunteering for the ordinance committee.
The zoning board will review the volunteers and three will be selected
at the meeting next month.
b. Commercial Truck Ordinance - John Ward from ES Attorney's drafted
an ordinance to restrict commercial truck traffic. A special meeting will
be held need to be held to review and vote on the ordinance.
Public Notice will be given and a draft of the ordinance will be posted on
the ACT website.
Supervisor Reis made a motion to hold a special meeting on Dec 2nd at
6:00 PM to discuss and vote on the commercial truck ordinance.

Motion approved. Clerk Schnaible will make the necessary arrangements.
4. New Business
5. Area Reports
A. School Board Report - Terry Woehl
The school board applied for 2 grants to help offset the cost of the foundation
repairs. But they were both rejected. However, BEK approved a $500 grant for
the repairs.
Some board members looked at a used portable classroom, but was not in a
condition they thought was worth the price and effort.
One Paraprofessional gave her 2 weeks' notice.
B. Treasurers Report - Randy Strom
1. Approve bills to be paid
Checking: $121,187.74
Savings: $36,425.60
1 CD @ $100,000 - 4 CD's @ $50,000
Total interest accrued to date on the CD's is $3,317.24
No bills were presented for approval.
C. Assessors Report - Marie Horning
Marie said she submitted her records to Burleigh County and should get them back in about a
Month. She also recently assessed four buildings.
D. Building Inspector's Report - Burleigh County
1. Review and approve the permit report
Supervisor Sicble made a motion to approve the permits on the permit report.
Chairman Dewing 2nd the motion.
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes
Motion approved.
E. Road Supervisors Report - Roy Kuil
Roy passed to the board the 2025 road maintenance agreement from the county.
The rains helped with the roads and the county did come and blade some of the worst roads
to fill in the holes and get rid of the washboards.
F. Weed Supervisors Report - Dusty Hasper
Dusty has nothing new to report.
6. Zoning Board
Chairman dewing recessed the regular board meeting and called to order the zoning board.
Roll Call: Dan - Present, Gaylen - Present, Monte - Present, Terry - Present, Terry - Present
A. Joe Gartner and Scott Reuschlein regarding number of horses allowed
Joe Gartner provided the board with a letter that he read at the meeting. However, as Clerk I was
not able to get a copy for the record.
Several members voiced their concerns on various aspects of this issue, a few summarized below:
1. The covenants should be still in effect
2. Should be allowed to have more horses than what the county allows for
3. A few stated they do not have any complaints or concerns about the horses.
The board weighed in and indicated that the matter before the board is closed. It is not up to the board
to determine if the restrictive covenants are still active or not nor it is the board's role to enforce or
interpret the Mees Estates restrictive covenants. It is up to the covenants committee in Mees estates
to resolve or it will have to be resolved between the parties in district court.
B. Update on Myrtle Holzer property
Monte talked to the lawyer to send another letter. Copy of the letter and a draft of the summons was
provided to the board.
There was a complaint voiced over people living in campers, tents and cars. The board advised that
Burleigh County is aware of the issues going on at the Holzer property and investigations are under
way.
Supervisor Reis made a motion to send the letter from the lawyer to Myrtle, if no response within the
given time frame, follow it up with the prepared summons.

Motion approved.
Monte is going to check to see if the previously approved fine was applied to the Holzer's property taxes.
C. Update on Rick Johnson property
Supervisor Reis is going to talk to Mitch to get an update. Previously Mitch was going through the
appeals process and a second letter about the illegal trailer house on the Johnson property.
7. Adjourn
Supervisor Reis made a motion to adjourn the meeting.
Supervisor Sicble 2nd the motion.
