ACT Board of Supervisors Meeting

In Attendance: Monte Sicble, Gaylen Dewing, Dan Reis, Jerry Kunz, Terry Woehl, Stephen Schnaible, Dusty Hasper, Roy Kuil and Randy Strom
1. Call to Order
Chairman Dewing called the meeting to order at 7:40 PM.
Meeting started after the Special Meeting about the potential
Truck Route Ordinance concluded.

2. Minutes Review
A. Corrections and approval of the Minutes from the previous meeting.
Supervisor Reis made a motion to approve the Nov. 2024 meeting minutes.
Supervisor Sicble 2nd the motion.
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes
Motion approved.
3. Old Business
A. Update on ordinance committee
Supervisor Sicble made a motion to accept Terry's recommendation on
the suggested members for the ordinance committee. (Jan Hamelton,
Sherry Leno, and Terry Woehl
Chairman Dewing 2nd the motion.
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes
Motion approved.
4. New Business
A. Zoning designation for property at 450 119th St NE
Klein property
Dakota Appraisals is potentially going to show this property to a prospective
buyer. 10 Acres - can't locate plotting to see if it is all one property. Also,
trying to figure out if it is all zoned residential. Supervisor Sicble is going to
visit with Mitch to see if any of these questions can be clarified.
5. Area Reports
A. School Board Report - Terry Woehl
Foundation work is still on hold. Nothing new to report.
B. Treasurers Report - Randy Strom
1. Approve bills to be paid
Checking: $126,946.92
Savings: $36,425.60
1 CD for $100,000.00
4 CD's for $50,000.00
Interest received on 100k CD's only is $2,520.55 as of 11/29/24.
Bills due: Fireside $840.00, TAO Interactive $299.95, Kelsch Law Firm
$480.00
Supervisor Sicble made a motion to pay the bills.
Chairman Dewing 2nd the motion.
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes
Motion Approved.
The board suggest to Treasurer Strom that he should start another
3-month $50,000.00 CD if the money is not needed during that time.
Treasurer Strom also mentioned a phone conversation with the IRS that
indicated ACT is past due for filing 941's starting in Sept 2019 to present.
Meaning ACT has not filed the 941's for almost 5 years. Randy is going
to work with the IRS to get them filed and up to date.
C. Assessors Report - Marie Horning

D. Building Inspector's Report - Burleigh County
1. Review and approve the permit report
Report was not yet available for the month of Dec. from Burleigh
County.
E. Road Supervisors Report - Roy Kuil
Road Supervisor Kuil is going to get the road maintenance map back
to the County, several roads need to be added to the list of roads
needing repair. Signed road maintenance agreement and maintenance
map is due by Jan. 1, 2025. Payment is due by April 1, 2025.
Annual gravel request map is due by April 15, 2025.
F. Weed Supervisors Report - Dusty Hasper
Nothing to report.
6. Zoning Board
Chairman Dewing recessed the regular board meeting and called to order
the Zoning portion of the meeting.

Jerry - Present.
A. Update on Myrtle Holzer property
Jeremy Alm with the Burleigh County Sheriff department is present and
described the criminal case they are pursuing regarding the Holzer property.
The criminal case is going to be done as a public nuisance. Jeremy has received
feedback from several residents in the area. That feedback included
trespassing, drug activity and other nuisances. People that come and go from
that property are reportedly living in vans, campers, and tents.
ACT attorney's should be issuing a civil judgement on Dec 3. This is separate
from what the sheriff's department is doing. This judgement is to clean up
the property as has been discussed for the past several months.
B. Update on Rick Johnson property
Supervisor Reis talked with Mitch and recapped what has happened thus far.
Two letters have been sent to Rick Johnson indicating that the trailer on their
property has not been issued a permit and will not be issued a permit.
Supervisor Reis is going to contact the Johnson's personally to see if he can
help get this resolved or moved along through a simple conversation.
