 Members Present: Chairman, Paul Zent; Supervisors, Kerry Olson & Ken Selzler; Zoning Board, Terry Woehl & Jerry Kunz; Assessor/Building Inspector, Ed Daniels; Weed Board, Terry Mauch; Treasurer, Shawn Whitney and Clerk, Cyndy Meidinger.


Members Absent: Road Supervisor Loren Wolf.


Chairman Zent opened the meeting and the minutes from the previous meeting were called for and read. With no corrections or additions Supervisor Olson made a motion to approve the minutes as read, 2nd by Supervisor Selzler. Motion was unanimously approved with Supervisors Olson, Selzler & Chairman Zent voting in favor of the motion.Motion Carried.


School Board Report: Lorraine Richard said the school board will be turning over the bill of sale for the latest portable. The building is 24’x60’ and the school board will be having some remodeling done on the inside and painting done on the outside. The small storage shed will be moved and put on a cement slab. Chairman Zent said the township would like to have an agreement written up for the transfer of ownership on the latest portable so there will be a paper trail. Mrs. Richard said there will be 72 students attending class this fall. There will be 2 students that can speak English but cannot read or write English. Chairman Zent asked if the township would be able to get some more space for storage. Mrs. Richard said she would talk to the school board to see if the township could utilize the space on the east end of the basement classroom.


Road Supervisor’s Report: In the absence of Loren Wolf Chairman Zent reported the county put up road closed signs on the east & west end of 48th Ave. The sign on the east end was not requested but the county put one up to be safe. Signs also went up on several cul-de-sacs, not through streets. The county is working with the railroad to make sure Creekside Drive is not damaged due to the train derailment. The county has started graveling. Zoning Member Kunz said the county had graveled Northgate Drive and it is ok. 106th St SE will get rip rap in the fall the shoulders are too soft to do anything with it now.


Weed Board Report: Mr. Mauch had no report but he did say the county is concentrating on spurge along Yegan Road, Apple Creek Road and Highway 10.


Assessor/Building Inspector’ Report: Mr. Daniels had no assessor report but he had 7 permits and 2 prospective new homes

Zoning Board:Chairman Zent suspended the Regular Meeting of ACT and opened the Zoning Board to allow discussion on a proposed subdivision southeast of Lincoln, and a house and garage encroachment @ 8351 Palomino Drive by Shannon & Tina Reichenberg. Shannon & Tina Reichenberg were refinancing their house and found out their house was 22’ 6” over the set back line to the west. It was missed when the property was built and sold the first time. After discussion Jerry Kunz made a motion to approve a special use permit/variance to approve the encroachment of the property 22’6” beyond the set back line to the west 2nd by Supervisor Olson. The motion was unanimously approved with Zoning Member Kunz, Supervisor Olson, Zoning Member Woehl, Supervisor Selzler and Chairman Zent voting in favor of the motion. Motion Carried. Brandon Aim from Element Solutions had a request for a subdivision Southeast of Lincoln and he wanted to know what needs to be done to get a subdivision in the township. Their client has 40 acres they would like to subdivide with a possibility of adding another 40 acres to make an 80 acre subdivision. A public hearing will need to be held, the 40 acre lot could have a total of 5 lots 4-5 acre lots and 1-20 acre lot. A zoning change and preliminary plat can be done at the same time. Interior roads need to be built up to county specs. Contact our road Supervisor Loren Wolf and then contact Rodney Ness at Burleigh County Highway Dept. 
Terry Mauch has 9 acres on the northeast corner of his commercial property north of Lincoln he wants to have it rezoned back to Ag. He just wanted input from the board he will do it at a later time. With no more zoning business to discuss Chairman Zent closed the Zoning Board and reconvened the regular meeting of ACT.

 


Treasurer’s Report: Treasurer Whitney reported there is $148,726.09 in the checking account. He also questioned how to pay Mr. Daniels. The board said Mr. Daniels could be paid quarterly for the meetings and monthly for his inspections and assessing duties. Treasurer Whitney said he had 3 bills to pay. After review Supervisor Selzler made a motion to pay all bills presented, 2nd by Supervisor Olson. The motion was unanimously approved with Supervisors Selzler, Olson and Chairman Zent voting in favor of the motion. Motion Carried.

Chairman Zent gave an overview of the Zoning Reg meetings so far and he said there will be some legal counsel at the Sept meeting to answer questions regarding the zoning regulations. He also said the September meeting will be one week later because of the Labor Day Holiday so the meeting will be September 13th.
With no other business to discuss Chairman Zent adjourned the meeting.
