Regular Meeting/Publilc Hearing

Members Present: Chairman, Paul Zent; Supervisors Kerry Olson, Ken Selzler; Zoning Board, Terry Woehl, Jerry Kunz; Treasurer, Shawn Whitney; Weed Board, Terry Mauch; Assessor/Building Inspector, Ed Daniels and Clerk, Cyndy Meidinger.
Chairman Zent opened the meeting; introduced the members of the board and called for the minutes from the previous meeting to be read. With no corrections or additions Supervisor Olson made a motion to accept the minutes as read 2nd by Supervisor Selzler. The motion was unanimously approved with Supervisors Olson, Selzler and Chairman in Zent voting in favor of the motion, Motion Carried.
School Board Report: No one present from the school board to give a report. Chairman Zent and Supervisor Olson met with the School Board to discuss the contract for the school building’s insurance and repair costs. Since no one from the school board was at the meeting this issue was tabled until the April meeting.
Road Supervisor’s Report: Supervisor Wolf talked to Rodney Ness at the county highway department about snow removal from problem ditch areas. Rodney thinks with the warmer weather the snow has settled and might not cause a problem so we will just have to wait and see. After review and discussion it was decided Snappy Lane should be included in the snow removal in the maintenance agreement. Snappy Lane serveds more than two homes so it would not be considered a private drive.
Zoning Board: Chairman Zent suspended the regular meeting of Apple Creek Township and opened the Zoning Board to hold a Public Hearing requested by Jon and Cherie Sanstead. The Sansteads are requesting a change of zoning on the Selzler Plat B from agricultural to commercial. That will allow them to have a horse facility on the property. They will be boarding some horses (6) inside the barn and have paddocks for (7) outside. In the future they plan on hosting horse related events. They have arraignments for water pit for now and have contacted Rural Water to have water brought in this spring or summer. The horse barn will have 24 hour camera surveillance and will be locked in the evening. There was a concern about the amount of horses the facility would have and the possible harm to the ditches from people using the ditches for riding. There will be an arena in side for riding the Sansteads have no control over people riding in the ditches but they do oppose riding in ditches. The plan is to max out at 20 horses. A discussion followed with Chairman Zent saying he would keep the Zoning meeting open for further discussion. He would call for more discussion and a vote later in the meeting.
JP Moszer was at the meeting to inform the board and residents of his plan to re-plat his property in City View Heights. He has lots 1, 2 & 3 he wants to sell one lot and change one lot to 4 1/2 acres covenants require 1 ½ acre lots. This was information only he will make a formal request at the April meeting.
Zoning Regulation update: There were 3 informational meetings this summer to discuss the changes in the Zoning Regulations the first meeting was well attended and attendance fell at each meeting thereafter. There were questions on voting on certain parts of the regulations, about beefing up the nuisance ordinances and suggestions on requiring vaccinations etc. There was a letter written to the township requesting the township use 3 acres as the lot size requirement. The board will stick with the 2 acre minimum as stated in the new Zoning Regulations. The consensus of the board is to vote on the new Zoning Regulations as written and any changes can be done as amendments as need arise. The Zoning Regulations will be voted on as they are written now with no further changes. The vote will be stated as yes you approve the new Zoning Regulations as written or no you do not approve and the old regulations will be used.
Chairmen Zent resumed discussion on the Sanstead Public Hearing. There was no further discussion Zoning Board member Kunz made a motion to approve Selzler Plat B from agricultural to commercial, 2nd by Zoning Member Woehl. Supervisor Olson said he thought the board should keep the property zoned as agricultural and use a special use permit for the facility that would give the board a little more flexibility for future use. After discussion the board decided to use the motion on the floor instead of keeping the zoning agricultural and using a special use permit. The motion was approved with Zoning Members Kunz, Woehl voting in favor of the motion Supervisor Olson voted against the motion and Supervisor Selzler and Chairman Zent abstained from voting on the motion, Motion Carried. With no further Zoning issues to discuss Chairman Zent adjourned the Zoning Board and reconvened the regular meeting of ACT.
Assessor’s Report: Assessor Daniels had one request for a homestead credit for Corrine Krein@ 3801 93rd St SE Assessor Daniels said Ms Krein did qualify for the credit. With no further discussion Supervisor Selzler made a motion to approve the homestead credit for Corrine Krein 2nd by Supervisor Olson. The motion was unanimously approved with Supervisors Selzler, Olson and Chairman Zent voting in favor of the motion, Motion Carried.
Building Inspector’s Report: Ed Daniels had one building permit for Allen Voller for a new house. Chairman Zent asked Mr. Daniels if he had certificates of occupancy. Mr. Daniels said he had.
Treasurer’s Report: Treasurer Whitney had 8 bills to pay for a total of $3,511.63 with a total of $140,404.17 left in checking.

School Tax: Tim Hagen from the Apple Creek School Board was on hand to answer questions on why the school tax went up so much. The main reason was for high school tuition and for special needs children’s tuition. There are 2 funds a general fund and a high school fund. The funds from the general fund can be transferred to the high school fund but excess funds in the high school fund cannot be transferred to the general fund. Mr. Hagen will be at the tax equalization meeting in April to answer school tax questions.
Reminder of the BCTOA meeting Wed March 9th @ AMVETS in Bismarck 9 AM all township officers can attend.
Reminder the annual meeting and election is Tuesday March 15th 7PM
With no other business to discuss Chairman Zent adjourned the meeting.
