Members Present: Chairman, Paul Zent; Supervisors, Kerry Olson & Ken Selzler; Zoning Board, Jerry Kunz & Rick Solberg, Weed Board, Terry Mauch; Treasurer, JP Moszer; Assessor/Building Inspector, Ed Daniels and Clerk, Cyndy Meidinger.


Chairman Zent opened the meeting; the minutes were called for and read. One correction was noted by Chairman Zent. The status of Snappy Lane had not been determined yet. Road Supervisor Wolf and Rodney Ness will discuss the issue and Supervisor Wolf will advise the board of their decision.

With no other corrections or additions Supervisor Selzler made a motion to accept the minutes as read 2nd by Supervisor Olson. The motion was unanimously approved with Supervisors, Selzler, Olson and Chairman Zent voting in favor of the motion, Motion Carried.


Chairman Zent asked for a vote for the Chairman position for the year of 2011-2012. Supervisor Selzler nominated Supervisor Olson, with a 2nd from Chairman Zent. The motion was unanimously approved with Supervisors, Selzler, Olson and Chairman Zent voting in favor of the motion, Motion Carried. After the vote Chairman Olson took over the meeting.


Chairman Olson introduced the new members of the board, Treasurer JP Moszer and Zoning Member, Rick Solberg.


School Board Report: There was no one present to give a school board update. Tim Hagen said he had not had time to get the agreement ready for the township board to review; but he said he should have something by the May meeting.


Road Supervisor’s Report: Supervisor Wolf advised the board of the closing of Apple Creek Road east of 93rd due to flooding and said there will probably be more closings in the future due to flooding so everyone should be on the lookout for water over the roads.


Building Inspectors Report: Building Inspector Daniels said he had 3 building permits and 2 more in the works.

Building Inspector Daniels also had 2 gas inspections 1 @ 8120 Irish Lane & 1 @ 2512 93rd St SE.


Assessor’s Report: Assessor Daniels said he sent out 130 notices of tax increases due to increased valuations due to new homes and improvements. Mr. Daniels also said the tax equalization meeting will be April 12th at the school @ 7PM. Tim Hagen will be on hand to represent the school board and answer school related questions.


Chairman Olson suspended the regular meeting of Apple Creek Township to open the Zoning Board to discuss changes to the proposed Zoning Ordinances. The procedure was to go through the proposed Zoning Ordinances line by line and discuss proposed changes. The Zoning Ordinances will be voted on after the regular meeting Monday May 2nd, a discussion followed with the following motions to change the proposed Zoning Ordinances.


Under 1.8 under Amendments: Supervisor Zent made the motion to use email notice of meetings seconded by Supervisor Selzler. The motion was unanimously approved with Supervisors Zent, Selzler, Zoning Members, Kunz, Solberg and Chairman Olson voting in favor of the motion, Motion Carried.


Article II
2.1Definitons:

Building: Supervisor Zent made the motion to strike the sentence (When a structure is divided into separate parts by unpierced walls extending from the ground up, each part is deemed a separate building) 2nd by Supervisor Selzler. The motion was unanimously approved with Supervisors Selzler Zent, Zoning Members Kunz, Solberg and Chairman Olson voting in favor of the motion, Motion Carried.


Family: Supervisor Zent made the motion to have the verbiage read a group of one or more related persons occupying a premise and keep the rest of the verbiage seconded by Supervisor Selzler. The motion was unanimously approved with Supervisors Selzler, Zent, Zoning Members Kunz, Solberg and Chairman Olson voting in favor of the motion, Motion Carried.


Private Garage: Zoning Member Solberg made the motion to change the verbiage to read an accessory building on the property of and for the exclusive use of the owner/tenant of the lot on which it is located 2nd by Zoning Member Kunz. The motion was unanimously approved with Zoning Members Kunz, Solberg, Supervisors, Zent, Selzler and Chairman Olson voting in favor of the motion, Motion Carried.


Article V
5.1 Supervisor Zent made the motion to add a The National Mobile Home Standard to the list of Standards and Codes 2nd by Supervisor Selzler. The motion was unanimously approved with Supervisors Selzler, Zent, Zoning Members, Kunz, Solberg and Chairman Olson voting in favor of the motion, Motion Carried.


Article VI
6.2.2 Zoning Member Solberg made the motion to change the minimum lot size in a subdivision to 5 acres and have a vote at the next annual meeting in 2012 to set up zoning districts seconded by Zoning Member Kunz. The motion was unanimously approved with Zoning Members Kunz, Solberg, Supervisors, Zent, Selzler and Chairman Olson voting in favor of the motion, Motion Carried.


6.4 Supervisor Zent made the motion to change the verbiage in 6.4.1 & 6.4.2 regarding tree & shrub setbacks to read from the center line of the road, 2nd by Supervisor Selzler. The motion was unanimously approved with Supervisors Selzler, Zent, Zoning Members Kunz, Solberg and Chairman Olson voting in favor of the motion, Motion Carried.


Supervisor Zent said a signature page will be added to the Zoning Ordinances, with no other Zoning issues to discuss Chairman Olson adjourned the Zoning Board and reconvened the regular meeting of Apple Creek Township.


Treasurer’s Report: Treasurer Moszer reported there were 11 bills to pay for $4,509.18, 4 checks deposited for $1,266.00 for an ending balance of $169183.99. After review Supervisor Zent made a motion to pay all bills presented, 2nd by Supervisor Selzler. The motion was unanimously approved with Supervisors Zent, Selzler and Chairman Olson voting in favor of the motion, Motion Carried.

Other Business: Chairman Olson reported that the ND INS Reserve meeting will be held on Wednesday, May 12th. He asked if anyone will attend the meeting. With no one attending the meeting Supervisor Zent made a motion to send in the vote for Rod Landblom to be a member of the board 2nd by Supervisor Selzler. The motion was unanimously approved with Supervisors Zent, Selzler and Chairman Olson voting in favor of the motion, Motion Carried.


Chairman Olson reminded everyone of the Tax Equalization Meeting, Tuesday April 12th @ 7 PM and reminded everyone the election for the Zoning Ordinances will be after the regular meeting on Monday May 2nd.


With no further business to discuss Chairman Olson adjourned the meeting.
