Regular Meeting

Members Present: Chairman, Kerry Olson, Supervisors, Paul Zent and Ken Selzler; Zoning Board, Rick Solberg; Weed Board, Terry Mauch; Road Supervisor, Lorin Wolf; Treasurer, JP Moszer and Clerk, Cyndy Meidinger.
Members Absent: Assessor/Building Inspector, Ed Daniels and Zoning Board Member, Jerry Kunz
Chairman Olson introduced members of the board the minutes were called for and read with no corrections or additions Supervisor Zent approved the minutes as read with a 2nd from Supervisor Selzler. The motion was unanimously approved with Supervisors Selzler, Zent and Chairman Olson voting in favor of the motion.
School Board Report: There was no one present from the school board to give a report. Clerk Meidinger said she had talked to Dottie Longmuir about the building agreement. Dottie said she had not had time this summer to do anything about the agreement but she would get a copy to the board. She said Shawn Whitney and Eric Kroh were the 2 new school board members. Ms Longmuir will email Clerk Meidinger an updated school board member list. Shawn Whitney said he would be one of the school board members that would be a liaison between the school board and township board.
Road Supervisor’s Report: Supervisor Wolf said he had talked to Rodney Ness about Beacon Loop in Apple Meadows. Mr. Ness said the least expensive and easiest fix would be to adjust the levels of the culverts in question. Some need to be raised and some need to be lowered. The ditches would need to be dredged and the black top would need to be cut and the grade on the ditches in question would need to be adjusted. Mr. Ness thought this could all be done for between $8,000 and $10,000. He also thought it could happen yet this year. That would depend on the weather and other projects that need to get done this year. Supervisor Selzler wants the supervisors to go out and take a look at the sight so they can make an informed decision. Supervisor Zent made a motion to approve the project contingent on the on sight inspection of the supervisors with a 2nd by Supervisor Selzler. The motion was unanimously approved with Supervisors, Selzler, Zent and Chairman Olson voting in favor of the motion.
Road Supervisor Position: Clerk Meidinger reported the Tribune did not run the ad for the Road Supervisor position so she wanted to know if the board wanted it placed in the Tribune. The ad will be placed for one weekend. The ad will run August 5th - August 7th with the interview date to be Monday, August 29th. There was one applicant that responded from Bisman Online. Treasurer Moszer said Glen Heiselman had expressed interest in the position he has worked for the DOT for 20 years.
Zoning Board Report: Zoning Board Member Solberg had nothing to report. Chairman Olson asked the board about the building permit issue in Mees Addition. There has been a building permit issued for a modular home and the covenants in Mees Addition only allow stick built or on sight built homes. The permit was first given when the City of Bismarck was thought to have jurisdiction; but after the permit was issued it was determined the jurisdiction belonged to ACT. Building Inspector Daniels issued a permit for ACT based on the thought that there was no issue with the home. There has been some discussion of the residents of the subdivision and the feeling is they are not happy with the home. There are several issues that need to be addressed the roof pitch, garage to name a few. With only one person left on the covenants committee the board strongly recommended there be at least 2 more members on the committee. With only one person on the committee there are be problems of getting answers to questions and the residents should decide how they want to handle this issue.
Item #2 there are several properties in Mees Addition that the grass is not being keep cut, buildings are in disrepair and are unsightly. Some of the properties are being used to store all types of vehicles, building materials etc. The lots are a harbor for lots of rodent pests, mice, skunks, gophers etc which can cause problems for the neighborhood. After discussion it was decided the ACT Board would have a letter sent to the property owners stating they are in violation of the Mees Subdivision Covenants and they need to clean up the property and if the buildings are found to be substandard the buildings will have to be removed. If the property owners do not comply the township will have the lots cleaned up, the grass mowed and if the building need to be torn down they will be removed and the total cost of the cleanup and removal will be charged to the land owners. In the letter the landowners will be asked to come to the next meeting of ACT which will be Monday, September 12th to visit with the township board to discuss how they can resolve the problems.
There was a question on Mariner’s Subdivision and if the paved roads were going further than the agreement allowed. The roads in question were cul-de-sacs and phase 2 if and when would need to go through the township board for approval.
There was a question on what the Reis’s auditor’s lot was. It was explained that the lot has no real improvement other than the house and the utilities there is no roadeasement to the property. The road is the road to Reis’s barn which is a private drive. If the property were to be sold it would have to be surveyed there would have to be easements etc. This way the house would go with the property if and when it would be sold. The auditor’s lot allows for mail, 911 and taxation of the property.
Assessor/Building Inspector’s Report: Mr. Daniels was not present to give a report but Clerk Meidinger said there were 2 building permits issued 1 was to Michael & Kristen Woodward @ 8155 Brads Way, in Fainman’s Sunrise Addition for a 3 stall garage, valuation of work $23,520.00 permit fee $126.00. #2 Bernard and Rae Eckroth @ 2925 Susan Drive in City View Heights for an 8’x12’ shed valuation $1,536.00 permit fee $35.00 for a total valuation of $23,646.00 and total fee of $1,571.00.
Jerry Segal was at the meeting and voiced his concern that Mr. Daniels and the builder missed a footing on his house when the property was inspceted. It was suggested by the board that they talk to Mr. Daniels and maybe there needs to be more communication between the board and Mr. Daniels.
Weed Board: Mr. Mauch said if the weather permitted spraying for leafy spurge would be this week. It was reported that there was a helicopter spraying along the railroad tracks. Mr. Mauch thought the railroad was spraying for thistle since it could be a fire hazard when the thistle dries up.
Treasurer’s Report: Treasurer Moszer had a starting balance of $177,921.55 2 bills for $1,000.01, 2 deposits from Burleigh County for $10,691.02, 2 building permits for $161.00 for an ending balance of $187,612.56

Treasurer Moszer said Inspector Daniels asked him to approach the board on how to handle people that are not getting permits. The board said normally the permit fee is doubled when it is obtained after the project is over. If there is going to be any other type of penalty it will have to be approved at the annual meeting and election in March.
Treasurer Moszer found the error in the books it was an addition error but he is going to have Pat Lengenfelder take a look at the books later.
Chairman Olson asked if there was any other business to discuss being none he adjourned the meeting of ACT.
