Members Present: Chairman, Ken Selzler; Supervisors, Kerry Olson & Paul Zent; Zoning Board, Jerry Kunz; Treasurer, Shawn Whitney; Road Supervisor, Lorin Wolf; Weed Board, Terry Mauch, Assessor Ed Daniels and Clerk, Cyndy Meidinger.

Members Absent: Zoning Board, Mike Michalenko and Building Inspector, Steve Ressler

The meeting was called to order and Chairman Selzler nominated Paul Zent to take the chairman’s position. Supervisor Olson asked what the requirements for being chairman since he was filling the last year of Dave Nehring’s position and Dave Nehring would have been the chairman for the year. There was a discussion and supervisor Olson 2nd the nomination. The nomination for Supervisor Zent to chair the 2010-2011 term was unanimously approved with Chairman Selzler, Supervisor Zent and Supervisor Olson voting in favor of the motion. The motion was carried.

Chairman Zent took over the meeting and the minutes were called for and read. Supervisor Olson noted one correction. The next hearing for Country View Estates will be at the Tom Baker room @ the city county building on Tuesday April 13th. With no other corrections or additions Supervisor Zent made a motion to accept the minutes as corrected with a 2nd from Supervisor Olson. The motion was unanimously approved with Chairman, Zent, Supervisors, Olson and Selzler voting in favor of the motion. The motion was carried.

The board then reviewed Dave Nehring’s resignation with Supervisor Selzler making the motion to accept the resignation 2nd by Supervisor Olson. The motion was unanimously approved with Supervisors Selzler, Olson and Chairman Zent voting in favor of the motion. The motion was carried.

School Board Report: No one present from the school board to give a report.
Road Supervisor’s Report: Supervisor Wolf said he was in contact with the county and they (the county) have a man checking the roads signs. The township will be able to access the report which will have when the signs were placed (dated) and the visibility checked. Supervisor Wolf also said the county recommended using more magnesium chloride on township roads to keep the dust down. There have been positive results on the roads that had been treated last season. Township supervisors will meet with Supervisor Wolf on a Saturday in the next couple of weeks to drive over the township and subdivision roads on a Saturday to enable supervisors to set up a gravel plan for this summer.

Weed Board Report: Terry Mauch had no report but he said Fertileawn got the county bid for weed control again. If anyone has or sees noxious weeds they should contact Terry and he will come out and check the weeds in question and flag if necessary & contact Fertilelawn to spray the weeds.

Zoning Board: No report. Chairman Zent opened the Zoning Board in conjunction with the regular meeting. Tyler Wollmuth was at the meeting to request a building permit. He said he had tried to contact Steve Ressler for a building permit. He said left various messages and got no response. He showed the board a copy of his blue prints and said his contractor was trying to contact Steve Ressler to get a permit. After discussion Supervisor Selzler made a motion to allow Mr. Wollmuth to start construction. The motion was 2nd by Supervisor Olson. The motion was unanimously approved with Supervisors Selzler, Olson and Chairman Zent voting in favor of the motion. The motion was carried. Clerk Meidinger will contact Mr. Ressler to get to get the permit process started. Cyndy Meidinger was requesting a variance to build a barn on her property @ 6305 Omar St. She had signatures of surrounding landowners approving the request. She will be tearing down the old barn and replacing it with a larger barn there are 2 out buildings on the property now a shop that is 30x57 and a shed 12x20 the barn will be 30x40. After checking the zoning regs, it was determined she was in compliance with the existing zoning regs. She will contact Mr. Ressler to get the permit.

There was a discussion on the absence of Zoning Board member Michalenko. Supervisor Olson said he would contact Mr. Michalenko to see if he wanted to complete his term and report back at the May meeting.

Mariners were at the meeting to see what steps needed to be done to get Country View Estates moving. They had their representative from KLJ Grieg present to answer any questions the board might have. The Mariners wanted to get the project going since they had been working on this project for a long time with the city of Bismarck. A discussion followed with these results. The Mariners did not know what the regulations for ACT were and were given the current zoning regulations. Mariners said they would consider 2 acre lots in a 40 acre tract with one approach on to Apple Creek Road with an emergency access that would be closed except for emergency vehicle use only.

The Mariners will have a subdivision map to show the board @ the May meeting and a time will be set up at that time for a public hearing on the proposed subdivision with a board vote @ that time.

Building Inspector’s Report: No report due to the absence of Steve Ressler.

Assessor’s Report: Assessor Daniels had no report but reminded everyone the Tax Equalization meeting will be Tuesday April 13th.

Web Page Update: Shawn Whitney gave the supervisors a handout of the web providers and various costs & services of the providers. After discussion Ken Selzler made a motion to accept Krafty Webworks as ACT’s website provider, the motion was 2nd by Supervisor Olson. The motion was unanimously approved with Supervisors Selzler, Olson and Chairman Zent voting in favor of the motion. The motion was carried.

Wm Teply Update: No update as of yet but Chairman Zent said he will contact Mr. Teply and get this taken care of.

Newsletter: The 2nd annual newsletter will go out the end of April.

Treasurer’s Report: Treasurer Whitney reported the township had $156,651.31 in the township checking account. Clerk Meidinger suggested the township put a portion of the money in a CD or savings account for future paving projects. With the low interest rate the board felt there could be more interest earned if it was left in the checking account. Treasurer Whitney had 7 bills to pay, after review Supervisor Selzler made a motion to approve the bills as submitted, 2nd by Supervisor Olson. The motion was unanimously approved with Supervisors Selzler, Olson and Chairman Zent voting in favor of the motion. The motion was carried.

Signature cards will need to be updated @ the bank. Clerk Meidinger will get signature cards & bring them to the next meeting.

NDIR Fund meeting will be held on Wed May 12th any of the supervisors may attend the meeting. None of the supervisors will be attending.

With no other business to discuss Chairman Zent adjourned the meeting.
