ACT Board of Supervisors Meeting

In Attendance: Monte Sicble, Dan Reis, Gaylen Dewing, Jerry Kunz, Terry Woehl, Stephen Schnaible, Dusty Hasper, and Roy Kuil.

 

1. Call to Order

Chairman Dewing called the meeting to order at 7:02 pm.

Roll Call: Dan - Present, Gaylen - Present, Monte - Present

2. Minutes Review

A. Corrections and approval of the Minutes from the previous meeting.

Supervisor Reis made a motion to approve the minutes from the
January 6, 2025 meeting.
Supervisor Sicble 2nd the motion.
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes.
Motion approved.


3. Old Business

A. Ordinance committee update

The committee has identified all the ordinances they want to address
and are currently working through the verbiage for the ordinances.

B. Zoning designation for property at 450 119th St NE
    Klein property - update?

Supervisor Sicble talked to Mitch at Burleigh County. The property
is 10 Acres and is currently zoned agricultural. Currently, no further
action is required.

 

4. New Business

A. Tax Abatement request

Chairman Dewing was not able to locate the abatement request
Clerk Schnaible will try to get a new copy from Burleigh County
so that it can be approved at the next meeting.

5. Area Reports

 

A. School Board Report - Terry Woehl

The software the school uses, "Power School" was hacked at the
national level. The school followed the recommended protocol and
performed a master password reset and informed the school staff
and parents.

B. Treasurers Report - Randy Strom

1. Approve bills to be paid

Checking: $114,532.44
Savings: Not Provided
5 CDs at $50,000 each
1 CD at $100,000

Bills: ES Attorney's $900.00

Chairman Dewing made a motion to pay the bills.
Supervisor Reis 2nd the motion
Vote: Dan - Yes, Gaylen - Yes, Monte - Yes.
Motion approved.

 

C. Assessors Report - Marie Horning

Not Present. Tax Equalization Meeting is scheduled for
April 7, 2025 following the regular township meeting.

D. Building Inspector's Report - Burleigh County

1. Review and approve the permit report
None were for Apple Creek Township


E. Road Supervisors Report - Roy Kuil

Nothing to report
 

F. Weed Supervisors Report - Dusty Hasper

Nothing to report

6. Zoning Board

Chairman Dewing recessed the regular meeting and opened the zoning portion
Roll Call: Dan - Present, Monte - Present, Gaylen - Present, Terry - Present, Jerry - Present

A. Update on Rick Johnson property

Rick was supposed to attend to plead his case, but he did not show up.
Supervisor Reis is going to get in touch with ACT's lawyer to proceed
with legal action against the Johnson's (or landowner) regarding the
mobile home that was not given a building permit.


B. Notice of Violation - Nathan Jensen
  8203 Apple Creek Rd Bismarck, ND 58501
Violation of Burleigh County Ordinance Article 21 Section 6.b, specifically
Flood Plain Development. New or temporary structures in the floodway.
The board agreed that Burleigh County should handle this as they are
managing the floodway area's (FEMA) for Apple Creek Township.
 

Chairman Dewing closed the Zoning portion of the meeting and reconvened
the regular meeting.

The board briefly discussed the newly proposed Truck Ordinance.
The new Truck Ordinance will be on the agenda for the next regular meeting.
New verbiage will be provided, and the board will vote on approving this
ordinance then.

7. Adjourn

Supervisor Sicble made a motion to adjourn
