ACT Board of Supervisors Meeting

In Attendance:  Gaylen Dewing, Dan Reis, Brandon Prichard, Jerry Kunz, Terry Woehl, Roy Kuil, Randy Strom, Sherry Leno and Marie Horning

1. Call to Order

Chairman Dewing called the meeting to order at 7:00pm.

2. Election of Chairman of the Board

Chairman Dewing made a motion to elect Supervisor Reis to position of Chairman
Supervisor Prichard 2nd the motion
Vote: Galen - Yes, Brandon - Yes, Dan - Yes
Motion approved - Supervisor Reis elected to position of Chairman

3. Oath of Office for new Board Members and Clerk

Dan Reis, Brandon Prichard and Sherry Leno swore their oaths.

4. Minutes Review

A. Corrections and approval of the Minutes from the previous meeting.
Supervisor Dewing made a motion to approve the minutes from the March 3, 2025 meeting

Vote: Dan - Yes, Brandon - Yes, Gaylen - Yes
Motion Approved


5. Old Business

A. Ordinance committee compensation

This was addressed at the 3/3/25 meeting

6. New Business

A. Speed limit change in City View Height (reported as Prairie View Heights) from 35 to 25

It was reported by several people in attendance that the speed limit is already 25.  Per discussion with the County changing speed limits signs may require traffic studies so it could become a major undertaking.

B. Obstructed view turning from 80th St onto Lincoln Rd.

Brandon Schock is involved with the new Lincoln housing development and indicated it may require a traffic study be completed.  This could include additional approaches and lowering speed limits near 80th on Lincoln Rd.

7. Area Reports

A. School Board Report - Terry Woehl

The School Board has an open position for Vice-Chair.  The School Board election is June 3, 2025.

The board is looking at a building to replace the main building.  Bismarck Public Schools has a portable for sale that is located at the Lincoln School.  Bids are due 4/22/25.  The board is hoping no change to the mill levy will be required.

B. Treasurers Report - Randy Strom

Cindy Meidinger cautioned that $352,964 is a large amount of funds and the County could take it.  Cindy indicated that several years ago the township had too much money and Burleigh County took a portion of it.  Roy Kuil indicated that this is the last year of a discounted road maintenane contract with the County.  He has not idea what the new contract will be.  Dan indicated he would ask some questions of the County.                                                                                     

C. Assessors Report - Marie Horning

Marie had nothing to report but would be holding the Tax Equalization Meeting

D. Building Inspector's Report - Burleigh County

1. Review and approve the permit report

Nothing to report

E. Road Supervisors Report - Roy Kuil

Roy had a report that sunrise development has a couple of road that need grading.  Odel reported that Windmill Rd needs blading - Roy will drive.  Cindy Meidinger indicated that 62nd & Omar should be bladed.  Trent Guthmiller indicated that the County is blading the highly used roads incorrectly.  Roy said he will visit with the county.  Private blading will be more expensive.  Stephen Schnaible stated that what we are doing doesn't appear to be working.

F. Weed Supervisors Report - Dusty Hasper

Dusty was not in attendance.

8. Zoning Board

Chairman Reis called to recess the regular meeting and open the Zoning portion of the meeting.

Terry Woehl swore his oath of office.

Roll Call: Dan - Present, Brandon - Present, Gaylen - Present, Terry - Present, Jerry - Present

The mobile home on the Rick Johnson property asked for a variance, however it did not meet the rules - the request was not valid. Dan reported that Rick Johnson will be attending the May 5th meeting.  Marie indicated that they need to fix the plat because the building is sitting 1/2 on the Johnson property and 1/2 on the Three Affiliated Tribes property.

Gaylen indicated that the signs are up for the Truck Ordinance. 

Trent Guthmiller indicated he had visited with Kathleen at the ND Attorney General's Office and she indicated that Apple Creek Township can not do what the ordinance says.  He also stated that he visited with the Highway Patrol and they also indicated that the ordinance is not correct.

Keli Berglund, Mayor, City of Lincoln indicated that the City has an issue with the Truck Ordinance, it limits commerce and has a direct financial impact on the City.

Brandon Schock. who works for the developer indicated that trying to restrict 22nd will affect the development.  The development will have multiple phases.  He states they will not use Dolan Rd.  He also indicated that they are now required to go to the City of Lincoln and Apple Creek Township.

Galen stated that the City of Lincoln only annexed half of 22nd and half of 80th, the township had to do something to protect their roads.

Trent Guthmiller indicated that trucks will now make three trips down the road to equal one load.

Galen again stated that if Lincoln had annexed all of 22nd and 80th, we would not be having this discussion.

The City of Lincoln's Attorney (Gaven Mindt from Vogel Law) has sent an open records request for the Truck Ordinance.  This request will be sent to the township's attorney that assisted with the ordinance.

8. Apple Creek Country Club

Ty Hauglie from Apple Creek Country Club requested review of the country club's liquor license.

Supervisor Dewing made a motion to approvve the liquor license
Supervisor Prichard 2nd the motion
Vote: Dan - Yes, Brandon - Yes, Gaylen - Yes
Motion carried.
