In Attendance:  Dan Reis, Gaylen Dewing, Brandon Prichard (by phone), Terry Woehl, Randy Strom, Roy Kuil, and Sherry Leno

1. Call to Order

Chairman Reis called the meeting to order at 7:00 pm

Dan requested that two items be added to New Business

A. Burn Barrel Complaint
B. Katie Aitchison asked to speak to ask questions concerning the Proposed Ordinances

2. Minutes Review

A. Corrections and approval of the minutes from the previous meeting.
Supervisor Dewing made a motion to approve the minutes from the October 3, 2025, meeting.
Supervisor Prichard 2nd the motion
Vote: Dan - Yes, Galen - Yes, Brandon - Yes
Motion approved

3. Zoning Board

Chairman Reis called to recess the regular meeting and open the Zoning portion of the meeting.
Roll call: Dan - present, Gaylen - present, Brandon - present by phone, Terry - present, 

A. Terry reviewed the amended Comprehensive Plan.

Gaylen made a motion to approve the Plan.
Dan seconded the motion.

During the discussion, it was recommended that the board hold off on approving the Plan until the proposed ordinances, which include the moratoriums, have been approved.

Gaylen rescinded his motion.  
Brandon seconded the motion.

B. Timeline for the second reading of the Proposed Ordinances

The second public hearing will be on November 25th at 7:00 pm

Chairman Reis closed the zoning board meeting and resumed the township meeting.

4.  Old Business

A. Rick Johnson Property 
Dan indicated that Rick is getting pricing for modular units.  The mobile will be replaced with a modular unit by May 2026.  There were many new faces in attendance, so Dan reviewed the history and indicated that fines have been assessed 

B. Holzer Property
John has removed lots of debris from his property.  Another citation has been issued to remove the campers from the property.  Fines have been assessed.  If the property is not cleaned up completely, the board will take the appropriate steps to let bids for the cleanup.  This cost will be assessed to the property.  Gaylen gave the history of this property.     

C. Ron King property
It appears he is starting to clean up.  Our lawyer will send another letter in about a week.

D. Nathan Jensen Property
Nathan has received permission to haul dirt onto the property.  The board is waiting to see what the State's Attorney and Burleigh County Zoning will decide on this property.  Gaylen gave a history of the building that was built in the floodplain.  The board and Burleigh County identified a spot where the building could be moved to.  The building has not been moved.

 

4. New Business

A. Burn Barrel Complaint

Terry Woehl, a resident of Faiman's Sunrise Addition, reported to the board that he was cleaning leaves earlier in the day.  While doing so, he discovered a partial page of a magazine that was charred/half burned, lying on top of the leaves that had fallen this weekend.  It was in one of the rows of a multi-row stand.  The previous Saturday, the neighbor was burning garbage in their burn barrel.  At the time, the wind was blowing from the southwest, carrying the smoke away from his house; however, the smell was very strong.  On Sunday morning, the burn barrel was still smoking.  By 11:30 am that day, the wind had switched and was blowing from the NW at 25 mph or greater.  Terry presumed that the wind blew the burned magazine page into the row of trees.  Terry searched his remaining property for more burned debris, but did not find any.  If a fire had started in the trees with the winds, it would not have been contained.  For this reason, Terry intends to file a complaint with the township concerning burn barrels.  Terry serves on the Zoning Board and offered to tender his resignation.  Chair Reis indicated that he was a resident of the township, and this is a reasonable complaint, there would be no need to resign.  Gaylen had concerns about acting on the complaint because we don't have an ordinance. 

Discussion took place with the attendees.  A question concerning whether the homeowners' insurance would cover any damage.  It was indicated that a citizen called their insurance and was told that it would depend on the adjustor, and the insurance company could go after the burn barrel owner.  It was also suggested that Terry talk with the neighbor instead of bringing this to the board.  Terry indicated that we would visit with the neighbor when they got home.  However, since this occurred today, Terry wanted to bring this to the board's attention.  Another resident indicated they burn once per year, they inform the neighbors, and water everything down in case something would happen.

B. Katie Aitchison asked to speak to ask questions concerning the Proposed Ordinances

Katie had questions concerning the proposed ordinances.  Terry indicated that when the process started, input was taken from the public.  After the input, a committee was formed.  After hearing complaints over the years, the board decided it was time to look at what was in place and what should be changed.  Katie indicated again she was just asking questions for information.  It was indicated that the board needs to get a handle on the conex boxes before they get out of hand. Everyone also needs to think about the ETA area of the City.  A question on acreage and counts was also asked, indicating it's a good idea to have limits.  If someone put 25 conex boxes on a 5-acre lot, that would not be good.  It was also recommended that the size of the boxes be reviewed; there is a difference between a 6-foot box and 58 58-foot box.  Another question was asked: Will they be counted against the sq ft use of your property?  Would like some conformity, an example, the boxes need to be side by side and not helter-skelter. 

Roy asked how long the temporary is.  Dan indicated  30 days.

Jamie Vetsh asked if variances need to be looked at every year.  She remembered some discussion on that in 2018 when she was treasurer.  She thought the variance and special use permit needed to be separated.

A question was asked about fines and fees - ND Century Code says townships can assess $2,000 to property per year, per violation.  The board's hands are tied.

A question concerning a timeline for the proposed ordinances was asked.  Gaylen indicated that at some time after the 2nd public hearing, the board will have a public discussion and make changes to the proposed ordinances, considering public comments.

A recommendation was made that temporary containers should be added to the ordinances.

C. 2026 Meeting Dates

6. Area Reports

A. School Board - Terry Woehl
The portable is getting put in place.  Contractors have been donating time and equipment.  The School Board is very appreciative of this.

C. Assessors' Report - Marie Horning
Marie was not in attendance.

The board received two requests for abatement of Real Estate Taxes.
The first for disabled vet credit and the second was a property value adjustment.

D. Building Inspector's Report - Burleigh County
Reviewed the October reports.

E. Road Supervisors Report - Roy Kuil
Roy indicated that the trees in the ditch were actually in Gibbs Township.  He believed the County would take care of them. Roy will visit with the County about some township roads that have been damaged by construction vehicles of the Lincoln annexed property.

Gaylen gave a history of the land annexed by the City of Lincoln for a housing development.  The section lines have been taken over by the county.  The county moved 22nd Ave to the section line and will build a road at the developers expense.

F. Weed Supervisors Report - Dusty Hasper - not in attendance
Informed Dan there was nothing to report.
