Special Meeting on Proposed Moratoriums

In Attendance:  Dan Reis, Brandon Prichard, Brian Masset, Terry Woehl, Jerry Kunz, Randy Strom, Dusty Hasper, Sherry Leno, and John Schmitt

Chairman Reis called the meeting to order at 7:00 pm

Dan handed the meeting over to Brandon to review the Moratoriums and take Public Comment.  

Brandon indicated that we are reviewing and accumulating data from around the state and nationally to help us.  We are shooting blind on all of this.

We can pass something, if there is something better that appears, we can change it and adopt that change.

Brandon indicated that this is the 1st reading of the moratoriums posted to the Apple Creek Township website for public review and comment.  

The Board of Supervisors will vote on the Moratoriums at the July 6, 2026, township meeting.

Moratorium #1

Mitch Kallevig asked if any company of any size would be prohibited.  The answer is yes.

The definition was discussed.  Dominick Johnson suggested that the definition be clearer.

Brandon made a motion to amend the definition of Data Center to the following:

Data Center shall mean any commercial, industrial, or special infrastructure used to house computer systems and associated components, such as telecommunications, data storage systems, crypto mining, and which may include backup power supplies, redundant data communications connections, environmental controls (e.g. air conditioning, fire suppression), and security devices.  This definition does not extend to residential use.

A resident asked if this applied to residential.  It does not and no changes are required stating this.

Moratorium #5

A resident asked about the definition of utility scale.  The Department of Energy's definition is 1 megawatt or greater.

Brandon made a motion to amend the definition of Solar Farm by adding the following statement at the end.  

This definition does not extend to residential use of solar panels.

Brandon made a motion to remove page 15 of the Proposed Ordinances.  This should not be in the document.

The Board of Supervisors adopted the Comprehensive Plan.

Terry indicated that the document had to be filed with Burleigh County.  There are very specific standards that must be followed when filing a document.  In addition, if a map is included, it must contain a stamp.  The road blading map created by the County is not good enough per the Attorney General guidelines.

Dan asked for any other comments.

There being none, Dan closed the meeting at 7:51 pm.
