ACT Board of Supervisors Meeting

In Attendance:  Dan Reis, Brandon Prichard, Brian Masset, Terry Woehl, Jerry Kunz, Randy Strom, Dusty Hasper, John Schmitt, and Sherry Leno

1. Call to Order

Chairman Reis called the meeting to order at 7:00 pm

2. Minutes Review

A. Corrections and approval of the minutes from the previous meeting.

Supervisor Prichard made a motion to amend the minutes to include that John Schmitt was appointed Road Supervisor. to the June 1, 2026, meeting minutes.

Motion approved

NOTE: The June 1, 2026, minutes already included the board's action appointing John Schmitt as the Road Supervisor.

The Board did not eliminate any items on the agenda, but did move the Zoning Board to the last item.

3. Public Comment

Jesse Hoeger asked about putting a 20 ft shipping container on 5 acres.  The board indicated that the township does not have an ordinance on shipping containers, therefor Burleigh County ordinances should be followed.

4. Old Business 

A. Rick Johnson Property 
The Johnsons no longer have an attorney.  The township is moving forward to get the trailer house moved off the property.  Brandon Volk asked for the history of the property.  Dan explained what has been going on with the property.

B. Holzer Property
Myrtle Holzer was in attendance.  She indicated that the eviction notice was thrown out by the judge because Jessica had nowhere to live, no job.  Myrtle offered her $30,000.  Myrtle has paid the cleanup tab on the property.  Three families and 6 dogs are living in the trailer.  Myrtle cautioned that neighbors need to lock their mailboxes.  Myrtle is in the process of getting an attorney.  Dan indicated that Myrtle needs to let him know by Friday if she has obtained an attorney.  If he doesn't hear from her, he will ask that our attorney move forward with the cleanup.      

C. Nathan Jensen property
The building is still present in the floodway.  Mitch gave him permission to move dirt, that is all.  No permit will be issued by the County until the building located in the floodway is gone.

5. New Business

The Comprehensive Plan was signed along with the Comprehensive Plan Resolution.

6. Area Reports

Randy indicated that we had an open records request for our accounts payable summary from 2022 to the present.  Randy would like to charge $25.00/hr with at least 40 hours of time for research.  The Board told Randy to contact our attorney for guidance.

C. Assessors' Report - Marie Horning

Marie could not attend.  She did email and indicated she didn't have anything.  Her contract is up, and she requested that it be put on the August agenda.

D. Building Inspector's Report - Burleigh County
June - nothing for ACT.
May - Eric Richards was already approved.

E. Road Supervisors Report - John Schmitt
John took the oath of office. 

He received a call from Chad Dunbar at the NDDOT.  A 50 ft culvert on 62nd Ave SE needs to be replaced; the one that is there is rotted through.

Apple Meadows - Beacon Loop, the township has received an estimate for a temporary fix.   Option #1 was for $21,795, and Option #2 was for $74,025.  The board will review other quotes when received.  These are temporary fixes; the board has to decide if these will be paid for by the Township or if they will be special assessed.  The county will only special assess if the cost is over $50,000.  The roads have large holes with asphalt chunks on the side of the road.  The board needs to look at chip sealing some of the developments; the roads are old.

Cody Dochtler indicate they were told by the County that Snappy Lane is a private road.  Dan will call Casey from Burleigh County.

F. Weed Supervisors Report - Dusty Hasper 
Dusty indicated that the County has contractors spraying, depending on the weather.

7. Zoning Board

Supervisor Prichard indicated that NDCC 58-03-13 does not require a second reading, but recommended that the board do so.

Ordinances will need to be developed for the moratoriums.

Dusty asked about the ordinances.  Dan indicated that the ordinances would be added to the next agenda as a discussion item, but no action would be taken.

Brandon indicated that the Board could do a 1st reading again after the discussion.  This would require a 15-day public notice.

Brandon also indicated that our Attorney stated that the township could do their best to produce minutes.

Dan closed the Zoning Board Meeting and resumed the Township Meeting.

Dan asked if there were any further comments.

Supervisor Masset requested that the September meeting be moved to September 15, 2026.  The board agreed.

Cody Dochtler asked about a variance.  He was told the information needed to be submitted by Friday so the Clerk could get the Public Notice in the paper.

Katie Aitchison asked why the ordinance process was so secretive.  She indicated that she went back and reviewed the minutes and found no information.  Dan indicated that the board took applications and announced who was chosen before the committee, and a motion was made to pay the committee members an hourly rate.
