In Attendance:  Dan Reis, Brandon Prichard, Brian Masset, Terry Woehl, Jerry Kunz, Randy Strom, Dusty Hasper, John Schmitt, and Sherry Leno

1. Call to Order

Chairman Reis called the meeting to order at 7:02 pm

2.  Public Hearing for Dockter Property

Chairman Reis called the public hearing to order.
A question concerning where the approach would go was asked.  The approach on 55th is a danger.  Dan indicated that Burleigh County indicated where the approach would go.  No other issues where indicated.

Supervisor Reis made a motion to approve the subdivision.

3. Minutes Review

A. Corrections and approval of the minutes from the previous meeting.

4. Public Comment

Jared Hanson - does not want the ordinances.  If the board passes them, he will take other avenues to block them.  People would appreciate fixing some of the ordinances but don't like the new ones.

Brandon Vogel - Asked if he had to get the board's approval to have another child.  He doesn't like the ordinances.

Jerry Kuntz - Property next door to him got annexed, and they are shingling the second house.  They need to empty the dumpster - garbage is lying in the ditch.  Does the Board need to talk to the Builder and the City of Lincoln?  If they don't do anything, maybe two letters can be written to the builder and the City with time frames, and if they don't do anything, the Township will hire a contractor.  It was suggested to call the City of Lincoln Administrator.  Township citizen Marv Abraham went to the City about the tumbleweeds on the property.  

Stephen Schnaible asked about the moratoriums and if they had been passed.  They were adopted at the August meeting.

Supervisor Masset indicated that we need to stay focused on the moratoriums.

Stephen Schnaible asked if we would allow a Data Center.  Terry Woehl indicated you can't prohibit them, but you can control where they go.

Another citizen asked if the township had Industrial Zoning?  Supervisor Reis indicated that would fall under Burleigh County.

Several people are asking to have the Proposed Ordinances go away.  The committee has not met in a few months.

Katie wants the committee to have open meetings on the ordinances that the public can attend.

Someone asked how the township will dissolve the committee.  Supervisor Reis indicated he would contact our Attorney and ask the question.

Marie had to leave the meeting early.  The Assessor's Report was moved to immediately before the Zoning Board.

Assessors Report

Marie indicated that the Schaffer Property will be getting a refund of the overage for their 2024 and 2025 taxes because of an error in the assessed value of their property.

Supervisor Reis made a motion to approve the new value.
Supervisor Prichard 2nd the motion.

Motion approved

Dan closed the regular meeting and opened the Zoning Board at 7:43 pm

5. Zoning Board

Roll Call - Dan, Brian, Brandon, Terry, Jerry

Robert Bolinske was in attendance.  He owns 10 acres in the Township and wants to divide the property into two 5-acre lots.  A citizen who had gone through this process indicated that the County will want the property platted.  Supervisor Reis recommended he contact Mitch Flannigan. Mr. Bolinske doesn't want to do that before he finds a buyer.  Once he has a buyer, they will negotiate what part of the property they want.  Dusty asked if the property was in Lincoln's ETA.  Marie verified that the property is in the City of Lincoln's ETA.  Mr Bolinske will have to go to the City of Lincoln.

93rd St from Apple Creek Road to 1804 - Resurfacing, Mill and Overlay

158th from the Interstate to Moffit Rd - this project is not in Apple Creek Township

Terry asked the Board for permission to email Casey from Burleigh County, asking that they do not start until after school is out and to be aware that there is summer school also.  One citizen was concerned; they are building a house next summer and will use 93rd St to bring in material.

The Zoning Board was closed at 8:03 pm.

6. Old Business 

A. Rick Johnson Property 
The mobile home is gone.  They will be moving a modular home onto the property.  Issue is closed.

B. Holzer Property
Myrtle Holzer was in attendance.  She was served with papers; she can't do anything and has no decision-making authority.  This issue will have to go to the courts.       

C. Nathan Jensen property
Building still in the floodway. 

D. Jamie Seims Gun Range
All the information has been turned over to the Township Attorney.  The Attorney will be researching the legality of the gun range.  Several citizens have issues with the gun range. 

E. Apple Meadows

Supervisor Masset thought it would take $15,000 to $20,000 to get the roads repaired for the winter.  John indicated it would cost $80,000 to fix the bad spots.  Dan did meet with the County; there are 2.73 miles.  The estimate to replace is 1.6 million plus engineering and cost overruns.  There are 87 lots; they need 52 lots to say yes to get a Special Assessment approved.  Development is 20-25 years old; the roads are falling apart.  The project to rebuild would be special assessed.  Dans wants to invite Casey or Dan from the County to the October meeting.  The County crack seals every other year.  Another citizen asked if it was possible to turn the roads to gravel.  Residential vehicles and garbage trucks are the main traffic on the streets.  The County will tell the township what needs to be done to get this project done.

7. New Business

A. 46th Ave SE - Jordan Oster indicated there are 4 homes and it's basically a prairie trail.  The homes will have to pay for road improvements. 

B. 2027 County Road Projects - discussed in Zoning Board.

C. Budget hearing - October Meeting - Clerk will publish the Public Hearing notice.  

8. Area Reports

A. School Board - Terry Woehl
School Board will hold its budget hearing on 9/21/26.  Board will be discussing options for the school.  If the school can't support the student population, it may go to the Bismarck Public School system.         

B. Treasurer's Report - Randy Strom 
Checking: $92,304.93
Savings:  $119.89
3 CDs totaling $216,502.61

1. Approve bills to be paid
Kelsch Law - $507.08 - Lawyer fees
Terry Woehl - $105.00 - Comprehensive Plan filing
The County submitted an invoice for $207,855.96 for Township Gravel Hauling by a 3rd party.

Randy presented two options to pay the invoice:

Option 1 - close all 3 CDs for a total of $217,485.08.  Less the County's invoice of $207,855.96.  This would leave a balance of $9,629.12 to be put into the checking account.

Option 2 - close 2 CDs for a total of $163,362.72, take the remaining $44,493.24 for the County invoice of $207,855.96 from checking.  This would leave a balance in the checking account of $47,811.69.

John is going to visit with the County about the invoice.

C. Assessors' Report - Marie Horning

Marie presented earlier in the evening. 

D. Building Inspector's Report - Burleigh County
No report was received. 

E. Road Supervisors Report - John Schmitt
Nothing to report.  He has called the County twice concerning Northgate.

F. Weed Supervisors Report - Dusty Hasper 
Nothing to report.
